Terms of Service

These Terms of Service ("Terms") govern your access to and use of Argentus, a personal finance web application ("Service") provided by JUMO LABS, a SASU registered in France (SIREN: 995 326 949) ("we", "our", "us"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 18 years old to use Argentus. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and complete information when creating your account
• You are the holder, or are authorised by the holder, of any bank account you connect

2. Your Account

2.1 Account Creation

You can create an account with an email address and password, or with Google Sign-In. You agree to:

• Provide accurate, current, and complete information
• Keep your password and account credentials secure and confidential
• Notify us immediately at argentus@jumolabs.com of any unauthorised access to your account

2.2 Account Responsibility

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to keep your account secure.

2.3 One Account Per Person

Each person may only create and maintain one account. Accounts are personal and may not be shared.

3. The Service

Argentus helps you track your money in one place. Its features include:

• Connecting bank accounts through open banking to import balances and transactions
• Adding accounts and transactions manually
• Categorising transactions, setting budgets, and viewing spending insights
• Tracking investments and their market value
• Forecasting future balances based on your data

We may add, change, or remove features at any time.

4. Bank Connections

4.1 Open Banking Provider

Bank connections are provided by GoCardless Bank Account Data (formerly Nordigen), a regulated account information service provider. When you connect a bank, you are redirected to your bank to authorise GoCardless to share your account information with us. Your use of the bank connection is also subject to the GoCardless terms presented during that flow.

4.2 Read-Only Access

Argentus has read-only access to your accounts. We can see balances, account details, and transaction history, but we cannot move money, make payments, or change anything in your bank accounts. We never see or store your online banking credentials.

4.3 Consent Duration

Bank authorisations expire after the period set by your bank, typically up to 180 days. After that, you will need to reconnect the account to continue importing data. You can revoke access at any time by removing the account in Argentus or through your bank.

4.4 Data Accuracy

Imported data comes from your bank. We are not responsible for errors, delays, or gaps in the data your bank provides, or for outages of your bank or of GoCardless.

5. Not Financial Advice

IMPORTANT: Argentus is a tool for organising and understanding your own financial information. It does not provide financial, investment, tax, or legal advice.

You acknowledge and agree that:

• Budgets, insights, and forecasts are estimates based on your data and simple assumptions, and may be inaccurate
• Investment prices and exchange rates come from third-party providers and may be delayed, incomplete, or wrong
• Argentus is not a bank, broker, or payment service, and does not hold your money or assets
• You are solely responsible for your financial decisions, and should consult a qualified professional before making significant ones

6. Pricing

Argentus is currently free to use. If we introduce paid plans, we will tell you in advance and explain the pricing. You will not be charged unless you choose to subscribe to a paid plan.

7. Acceptable Use

You agree to use Argentus only for lawful, personal purposes. You agree NOT to:

• Access accounts or data you are not authorised to access
• Share your account credentials with others
• Attempt to gain unauthorised access to the Service, other users' accounts, or our systems
• Use automated tools (bots, scrapers, scripts) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Upload malicious code or interfere with the operation of the Service
• Use the Service for any commercial purpose or on behalf of third parties
• Use the Service to launder money, commit fraud, or for any other illegal activity
• Violate any applicable laws or regulations

8. Your Data

8.1 Ownership

You retain all rights to the data you add to or import into Argentus, including transactions, categories, budgets, notes, and investment records.

8.2 License to Us

You grant us a limited, non-exclusive, royalty-free license to store and process your data solely to provide and improve the Service. We will never sell your data or use it for advertising.

8.3 Privacy

Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you agree to the practices described in it.

9. Third-Party Services

The Service relies on third-party services including:

• Supabase (authentication and database)
• Google Sign-In (authentication)
• GoCardless Bank Account Data (bank connections)
• Twelve Data, Coinbase, and Frankfurter (market prices and exchange rates)
• Vercel and Google Cloud (hosting)

Your use of these services may be subject to their own terms. We are not responsible for third-party services or their availability.

10. Intellectual Property

The Service and all of its content, features, and functionality, including software, text, graphics, and logos, are owned by JUMO LABS and are protected by copyright, trademark, and other intellectual property laws. "Argentus" and related logos are our trademarks. You may not copy, modify, or create derivative works of the Service, or use our trademarks without our prior written consent.

11. Account Termination

11.1 Termination by You

You may stop using the Service at any time. To delete your account and its data, contact us at argentus@jumolabs.com. Upon deletion, your access is revoked, your bank connections are removed, and your data is deleted as described in our Privacy Policy.

11.2 Termination by Us

We may suspend or terminate your account, with or without notice, for:

• Violation of these Terms
• Fraudulent or abusive behaviour
• Activities that harm the Service or other users
• Legal or regulatory reasons

11.3 Effect of Termination

Upon termination, your license to use the Service ends and we may delete your data, subject to legal retention requirements. Provisions that by their nature should survive (disclaimers, limitations of liability, indemnification) will continue to apply.

12. Disclaimers and Limitation of Liability

12.1 "As Is" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Imported, calculated, or third-party data is accurate or complete
• Defects will be corrected

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUMO LABS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Financial losses arising from decisions made using the Service
• Errors or inaccuracies in balances, transactions, prices, or forecasts

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Nothing in these Terms limits liability that cannot be limited under applicable law, including your rights as a consumer.

13. Indemnification

You agree to indemnify and hold harmless JUMO LABS and its officers, directors, employees, and agents from all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.

14.2 Informal Resolution

Before filing a claim, you agree to contact us at argentus@jumolabs.com so we can try to resolve the dispute informally and in good faith.

14.3 Jurisdiction

Subject to your mandatory consumer rights, any dispute arising from these Terms or the Service shall be subject to the jurisdiction of the courts of France.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or with a notice in the Service, and update the "Last updated" date above. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, are the entire agreement between you and JUMO LABS regarding the Service.
• Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
• Waiver: Our failure to enforce any provision is not a waiver of that provision.
• Assignment: You may not transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.
• Force Majeure: We are not liable for any failure or delay caused by circumstances beyond our reasonable control.
